Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PillWise mobile application and website (the "Service"), operated by Tugadot ("PillWise", "we", "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

PillWise is a medication management tool that helps you record medications, receive reminders, track adherence, log symptoms, store e-scripts, view interaction information, and optionally share reports with healthcare providers or caregivers.

2. Medical Disclaimer

PillWise is NOT a medical device and does NOT provide medical advice, diagnosis or treatment. The Service is a tool to help you organise and track your medications. It is not a substitute for professional medical care. Always consult a qualified healthcare professional before making decisions about your medications or health, and never disregard or delay seeking professional advice because of something in the Service.

Interaction warnings, reminders, and insights are provided for general information only and may be incomplete or inaccurate. In an emergency, call 000 (or your local emergency number) immediately. Do not rely on PillWise in emergency situations.

3. Eligibility

You must be at least 18 years old to use the Service. Minors may only use PillWise under the direct supervision of a parent or guardian who agrees to these Terms on their behalf.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us immediately of any unauthorised use at hello@pillwise.com.au.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in breach of any applicable law.
• Enter false health information or impersonate another person.
• Attempt to access another user's account or data without authorisation.
• Copy, modify, reverse-engineer, or interfere with the Service or its security.

6. Caregiver Features

You may invite caregivers to view or help manage your medications. You are responsible for who you invite, and you can revoke access at any time. Caregivers must use any information they access solely to support you and in accordance with these Terms.

7. Fees and Subscriptions

PillWise is free to download with core features available at no cost. We may offer optional premium plans. Where purchases are made through the Apple App Store or Google Play, they are billed by that platform and subject to its terms. Subscriptions auto-renew unless cancelled through your device's store settings before the renewal date, and partial-period refunds are generally not provided except where required by law.

8. Privacy and Your Data

Your use of the Service is also governed by our Privacy Policy. You retain ownership of the health data you enter. Where we use AI features, your data is processed to deliver the feature to you and any model improvement uses de-identified data only.

9. Intellectual Property

The Service, including its software, design and content, is owned by Tugadot and protected by law. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for its intended personal purpose. You retain ownership of your own content.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, except as required by law. We do not warrant that the Service will be uninterrupted, error-free, or that reminders or information will always be delivered or accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Tugadot is not liable for any indirect, incidental or consequential loss, loss of data, or any health outcome arising from your use of or reliance on the Service. Our total liability for any claim is limited to the amount you paid us (if any) in the three (3) months before the claim.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law.

12. Indemnification

You agree to indemnify and hold harmless Tugadot from any claims, losses or expenses arising from your breach of these Terms or misuse of the Service, except to the extent caused by us.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or where reasonably necessary to protect the Service or other users. On termination, your right to use the Service ends and your data is handled as described in our Privacy Policy.

14. Apple App Store

If you download PillWise from the Apple App Store, you acknowledge that these Terms are between you and Tugadot only, not Apple, and that Apple is not responsible for the Service or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

15. Governing Law & Disputes

These Terms are governed by the laws of Australia. We encourage you to contact us first to resolve any dispute in good faith. If a dispute cannot be resolved, it will be subject to the jurisdiction of the courts of Australia.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version, and we will notify you of material changes by email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
